	Terms Terms are 1% 10 days, net 30 days, with approved credit, VISA and MasterCard are accepted. Prior to approved credit, payment must be received before shipping. Credit Three trade references (in addition to your bank and account number) are required, If your account goes 30 days without payment, no merchandise will be shipped until past due balances are paid. Redelivery of Freight When redelivery of merchandise is required because the customer is unable to accept the merchandise and no notification of this fact was given to American Sales & Marketing at least two weeks prior to the scheduled ship date, the actual cost for freight, rehandling and warehousing, plus a 10 percent surcharge, will be billed to the customer. Deductions No deductions will be allowed from invoices for any reason without authorization from American Sales & Marketing. Cancellations/Returns No merchandise will be accepted by American Sales & Marketing for exchange or credit without our expressed written consent before return shipment is made. All freight charges on returned merchandise must be prepaid. American Sales & Marketing will not accept freight collect shipments. Prices All list prices are subject to change without notice, Call for pricing on orders of less than minimum quantities. Shipping Date Orders will be shipped as close as possible to the approximate shipping date designated on the order acknowledgement, American Sales & Marketing will not be liable for delay in shipment or delivery of the order or for damages claimed to result front such delay, Product Design American Sales & Marketing reserves the right to make changes in design and construction and discontinue products without prior notice. All dimensions shown are considered to be approximate, Lead Times American Sales & Marketing will quote lead time upon request and will use its best efforts to obtain delivery within quoted lead times. However, American Sales & Marketing will not be responsible for any damage caused by late delivery. Shipping Charges Customer will pay freight - FOB factory. Partial Shipments Partial shipments will he made upon request. What is shipped will be invoiced and payable under American Sales & Marketing terms, Balance of order will be shipped when available. Transit Damage All merchandise is packed in an approved manner. Inspect all merchandise immediately. If a carton is or appears to he damaged, do not unpack it. Call the carrier for immediate inspection. Notification of concealed damage must he made to the company delivering the goods in writing within the time period allowed by the freight company for making such claims. Title to the goods and risk of loss pass to the buyer once American Sales & Marketing or its vendors deliver its goods to the carrier. Damage Claims In the unfortunate event that freight damage or loss occurs, call your freight carrier to file a claim, Consignee is responsible for inspecting deliveries and verifying carton counts; noting any visible damages or shortages on delivery receipt BEFORE signing. Signing subject to inspection does not qualify as signed damage. American Sales & Marketing is not responsible for concealed damage claims if customer service has not been notified within 10 days of receipt goods, Warranties American Sales & Marketing warranties its products to he free from defects in material and workmanship for a period of one (1) year from the date of initial delivery. This warranty made by American Sales & Marketing only to purchaser acquiring the product directly from American Sales & Marketing, its authorized dealers, or others who are specifically authorized by American Sales & Marketing to sell such products. American Sales & Marketing obligation and the purchaser's remedy, pursuant to this warranty are limited to repair or replacement, at American Sales & Marketing option, FOB American Sales & Marketing headquarters, of replacement parts which prove, under normal use, to be defective within the period stated, which remedy is expressly agreed to be exclusive as a condition of such replacement. No person, firm, or corporation is authorized to assume for American Sales & Marketing any other liability in connection with American Sales & Marketing products. Customer will get credit for returns only after they are received by American Sales & Marketing. Products and must be returned within 30 days of receipt of shipment. THERE ARE NO WARRANTIES EXCEPT AS EXPRESSLY SET FORTH ABOVE, EITHER EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. AMERICAN SALES & MARKETING LIABILITY WITH RESPECT TO ITS PRODUCTS SHALL NOT EXCEED THAT EXPRESSLY SET FORTH ABOVE IRRESPECTIVE OF THE THEORY UPON WHICH ANY CLAIM MIGHT BE BASED INCLUDING BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, OR STRICT LIABILITY ON TORT. UNDER NO CIRCUMSTANCES SHALL AMERICAN SALES & MARKETING BE LIABLE FOR SPECIAL INCIDENTAL, OR CONSEQUENTIAL DAMAGES. This warranty does not apply to damages resulting from shipment, storage, accident, alteration, misuse, assembly or installation. All claims under this warranty must be authorized in writing by American Sales & Marketing prior to the repair or replacement of products. THESE PRICES SUPERSEDE ALL PREVIOUS CATALOG PRICES.
